I think you may recieve tattoo tears for attempting to kill someone as well. I knew a guy who took a shot, but missed and got a tear in prison.

I'm pretty sure the consequences of getting a marking like that under false pretences are pretty harsh, so it's probably valid for attempted murder, as well as an actual kill.
