I don't get why everyone keeps whining about this topic. It was never meant to be put on DVD. Just get over it and be happy you were there.

I could never get my head around why Universal/IDJ did not agree terms that would usually be found clearly stated in the record contract, of course IDJ does not have to release any of the Utada?s work if they do not see fit, a behaviour that could be damaging for any artist who will spend years producing an album only for it to be turned down, however IDJ could have stipulated exclusive rights to the copyrights of all Utada?s ?English? songs , IDJ may have also insisted that U3 does not make any recordings or performances for anyone else without the IDJ prior permission, I have been lectured in classes that from a financial point of view Copyright is a form of property, ?copyrighted? work is an instrument that can be owned by a person or company as a ?property?, in whole or % shares.......

So I cornered a lecturer in copyright law who specialises in US constitutional rights management (whatever that is supposed to mean, lol), between wedging my eyelids open with cocktail sticks, I got the in and outs about when copyright was first established in 1790, the Berne convention, and advised to start researching from when Utada first signed to IDJ, because it is at this point that clear financial considerations and commercial interests are established and how permissions are used as a instrument to protect copyright.

Now on March 16 2002, U3 signed a deal that could be the root of all difficulties in formulating an agreement for the release of ?in the flesh?, the formal demonstration of ownership rights ....Billboard points out the problems .....

The English-language album deal was set up by Island Def Jam Music Group president/CEO Lyor Cohen, who says Utada's first set will be recorded in New York this summer, "hopefully with the likes of the Neptunes and Rodney Jerkins," in time for release later this year or early in 2003.......

Now when was Exodus released !? ...lots more to come ....

Agreed. Not that there was any other artist I bought on the IDJ label aside from Utada. And if they're being this ostentatious about the concert footage (assuming it is IDJ that's holding everything up, although I can't imagine anything else would be), I can bet it's going to be hard for Utada, her management et al to wrangle song rights away from them (if they even care to). I'd hate to have to say goodbye to live renditions of Kremlin Dusk and YMMWBM, to say nothing of all the TITO songs that were so fantastically performed during "In the Flesh". :/

I guess we can thank the greedy bastards at Island Def Jam for depriving us of this show.
Looks like we are never gonna get this DVD, it's been nearly 2 years now.

I will never buy another album, mp3 or whatever from this POS record label.
